Notice of Administrative Regulations Filed with the Legislative Research Commission

Pursuant to KRS 13A.220(8) the Secretary of State hereby provides notice of the filing of the following Administrative Regulations.  These administrative regulations may be accessed on the Legislative Research Commission's website: https://apps.legislature.ky.gov/law/kar/TITLE030.HTM

30 KAR 3:010 Application for registration of trademarks and service marks has been amended to incorporate by reference the "Trademark/Service Mark Application (02/20)" and to reflect the current website address of the Secretary of State: sos.ky.gov.

30 KAR 3:020 Application for renewal of registration has been amended to incorporate by reference the "Trademark/Service Mark Renewal Application (02/20)" and to reflect the current website address of the Secretary of State: sos.ky.gov.

30 KAR 3:030 Classification of goods and services for registration of trademarks and service marks has been amended to reflect updates to the classification system to include modern goods and services; to correct the classification of "Legal Services" from class 42 to class 45; and to reflect the current website address of the Secretary of State: sos.ky.gov.

PUBLIC HEARING AND PUBLIC COMMENT PERIOD (30 KAR 3:010, 30 KAR 3:020, 30 KAR 3:030)

A public hearing on these administrative regulations shall be held on November 23, 2021, at 9:00 a.m. EST, at Office of the Secretary of State. Individuals interested in being heard at this hearing shall notify this agency in writing by five (5) work days prior to the hearing, of their intent to attend.  If no notification of intent to attend the hearing is received by that date, the hearing may be cancelled. A transcript of the public hearing will not be made unless a written request for a transcript is made.  If you do not wish to be heard at the public hearing, you may submit written comments on the proposed administrative regulation. Written comments shall be accepted until November 31, 2021. Send written notification of intent to be heard at the public hearing or written comments on the proposed administrative regulation to the contact person.

30 KAR 6:011E Kentucky address confidentiality program was filed as an emergency regulation to implement KRS 14.300, 14.302, 14.304, 14.306, and 14.310 which establishes Kentucky's address confidentiality program to protect personal information for victims of domestic violence and their ability to vote for the upcoming November 2, 2021 special elections.

A public hearing on these administrative regulations shall be held on October 24, 2021, at 10:00 a.m. EST, at Office of the Secretary of State. Individuals interested in being heard at this hearing shall notify this agency in writing by five (5) work days prior to the hearing, of their intent to attend.  If no notification of intent to attend the hearing is received by that date, the hearing may be cancelled. A transcript of the public hearing will not be made unless a written request for a transcript is made.  If you do not wish to be heard at the public hearing, you may submit written comments on the proposed administrative regulation. 30 KAR 5:021E was filed as an emergency administrative regulation to implement KRS Chapter 255.9.  This administrative regulation establishes the general provisions for 30 KAR Chapter 5 governing delivery, approved forms, payments and public services.

30 KAR 5:031E was filed as an emergency administrative regulation to implement KRS 355.9.  This administrative regulation establishes the requirements relating to the acceptance and refusal of records.

30 KAR 5:041E was filed as an emergency regulation to implement KRS Chapter 355.9.  This administrative regulation establishes the requirements for the UCC information management system.

30 KAR 5:051E was filed as an emergency regulation to implement KRS Chapter 355.9.  This administrative regulation establishes requirements related to filing, indexing, and date entry procedures.
